ATHLETE'S PARTICIPATION AGREEMENT, LIABILITY WAIVER, AND CONSENT

1. Agreement to Participate and Understand Your Rights

This document is a legally binding agreement between you (the "Participant") and the Korea Canada Baseball Softball Association and Maple Leaf Baseball/Softball League, including all their affiliated leagues (collectively referred to as the "Organizations").

Before you participate in any baseball or softball activities organized or sponsored by the organization, it's very important that you fully understand and agree to the terms outlined below. These activities include, but are not limited to:

On-Field Activities: Games, competitions, tournaments, practices, and training sessions.

Skill Development: Personal or strength training, dry land training, and training using machines or weights.

Educational Programs: Nutritional and dietary programs, orientation sessions, instructional sessions or lessons.

Fitness Programs: Aerobic and anaerobic conditioning programs.
Online Programs: Webinars, remote conferences, workshops, and online training sessions.

By signing this agreement, you confirm that you are either of legal age in Ontario (18 years or older) or have the consent of your parent or legal guardian (if you are under 18). If you have any questions or concerns about this agreement, please ask a Organizations representative for clarification before you sign.

Your participation in any of the above-mentioned activities (collectively called the "Activities") is conditional upon your understanding and acceptance of these terms.

2. Disclaimer of Responsibility for Injuries and Losses
The Organizations, which include their respective directors, officers, committee members, members, employees, coaches, volunteers, officials, other participants, agents, sponsors, and the owners/operators of the facilities where the Activities take place, will not be held responsible for any injury, personal injury, damage to your property, financial loss (including loss of income), or any other kind of loss you may experience during or as a result of participating in the Activities.

This means that even if your injury or loss is caused by something the Organization or someone associated with them did or didn't do (including negligence), you agree they are not liable.

3. Understanding and Acknowledging the Risks Involved

You understand and acknowledge that participating in baseball and softball involves significant risks, hazards, and dangers, some of which cannot be completely eliminated, even with the utmost care and caution.

These risks include, but are not limited to:

Serious Injuries: The potential for serious bodily injury, permanent disability (such as paralysis), and even death.

Online Program Risks: Online programs may have different risks associated with them compared to in-person activities, such as technical issues, lack of direct supervision, and the suitability of your home environment for the activity.

Limitations of the Organizations: While the Organizations strive to ensure safety, they cannot guarantee it. They may not be fully aware of your current physical condition or abilities, might misjudge weather or environmental conditions, may not provide complete warnings or instructions, and the equipment used could potentially malfunction.

COVID-19 Risks: The COVID-19 pandemic is ongoing, and the virus is highly contagious. While the Organizations have implemented preventative measures to reduce the spread, there is still a risk that you could contract COVID-19 by participating in the Activities. Participating in group activities increases your risk of exposure.

4. Voluntary Participation and Awareness of Specific Risks

You are choosing to participate in the Activities voluntarily.

By doing so, you acknowledge the numerous risks, dangers, and hazards associated with or related to these Activities.

You understand that even if Organizations take precautions, they may not be able to protect you from all of these risks.

Some of these risks include, but are not limited to:

-Health Risks:
-Performing physically demanding techniques.
-Physical exertion and overexertion.
-Stretching improperly.
-Dehydration and fatigue.
-Cardiovascular strain from workouts.
-Sudden and rapid movements and stops.
-Injuries due to a lack of proper fitness or conditioning.
-Traumatic injuries such as sprains, fractures, and spinal cord injuries.
-Bacterial infections and rashes.
-Transmission of communicable diseases, including all types of viruses (like COVID-19), bacteria, parasites, or other organisms, and any mutations.

Facility Risks:
-Defective, dangerous, or unsafe conditions of the baseball/softball fields and related facilities.

-Falls due to uneven surfaces or obstacles.
-Collisions with objects (like fences, sprinklers), equipment, or other people.
-Dangerous, unsafe, or irregular conditions on the grass, diamond, or other playing surfaces.
-Risks associated with extreme weather conditions, including lightning.
-Risks involved in travelling to and from the locations where the Activities occur.

Equipment Risks:
-Mechanical equipment failure (like bats, helmets, protective gear).
-Negligence in the design or manufacturing of equipment.
-The Organization fails to provide adequate warnings, directions, instructions, or guidance on how to use equipment safely.
-Failure to wear required safety or protective equipment.
Using or operating equipment beyond your skill level or ability.

Contact Risks:
-Physical contact with fences, bleachers, the ground, bases, bats, balls, other equipment, vehicles, or other individuals.
-Other types of contact that could lead to serious bodily injury, including concussions, other brain injuries, or serious spinal injuries.

Advice Risks:
-Negligent or incorrect advice the Organizations or their representatives give regarding the Activities.

Ability Risks:
-Failing to act safely or within your physical limitations or designated areas.

Sport-Specific Risks:
-The inherent risks of playing baseball and softball, such as being hit by a pitched or batted ball, or a bat.
-Injuries sustained while running or sliding.
-Collisions with umpires or other participants.
-Slipping or tripping on a base.
-Injuries occurring while entering or leaving the dugout area, bullpen, batting cage, or bleachers.

Cyber Risks:
-Risks related to online activities include privacy breaches, hacking, and technical malfunctions or damage.

Conduct Risks:
-Risks arising from your conduct or the conduct of other participants, including physical altercations.

Travel Risks:
-Risks associated with travelling to and from the locations of the Activities.

Negligence Risks:
-Risks resulting from your negligence or the negligence of others, INCLUDING NEGLIGENCE ON THE PART OF THE ORGANIZATIONS, which could increase the risk of damage, loss, personal injury, or death.

5. Your Responsibilities as a Participant

By participating in the Activities, you agree to the following:

Responsibility for Your Training Environment:
-When you practice or train independently, you are solely responsible for ensuring the safety of your surroundings, the location you choose, and the equipment you use.
Appropriate Physical and Mental Condition: You confirm that your mental and physical condition is appropriate for participating in the Activities and accept all risks related to your mental and physical health.

Compliance with Rules and Regulations:
-You will follow all rules and regulations established for participation in the Activities.

Compliance with Facility Rules:
-You will adhere to all the facilities' rules and regulations where the Activities occur.

Reporting Hazards:
-If you notice any unusual or significant hazard or risk during your participation, you will immediately stop participating and inform a representative of the Organization about your observations.

No Participation While Impaired:
-You will not participate in the Activities if you are impaired in any way (e.g., due to alcohol, drugs, or medication), as this increases the risks involved.

Assessing Activity Difficulty:
-It is your responsibility to figure out if any Activity is too challenging for your current abilities.
-By starting an Activity, you acknowledge that you have assessed its suitability and conditions and accept them.

Responsibility for Protective Equipment:
-You are responsible for selecting and properly fitting any safety or protective equipment you use.

COVID-19 Acknowledgement:
-You understand that COVID-19 is a contagious disease and that you may be exposed to or become infected by it while participating in the Activities. You acknowledge that such exposure could lead to personal injury, illness, permanent disability, or death.

6. Release of Liability and Indemnity Agreement

In exchange for the Organizations allowing you to participate in the Activities, you agree to the following:

Sole Responsibility for Your Safety:
-You understand and agree that you are ultimately responsible for your safety during the Activities.

Assumption of All Risks:
-You voluntarily assume all risks that arise from, are associated with, or are related to your participation in the Activities, whether listed in this document or not.

No Reliance on External Statements:
-You are not using any statements (whether spoken or written) made by the Organizations or their representatives (including in brochures, advertisements, or conversations) as a reason to participate in the Activities.

Waiver of All Claims:
-You give up any claims that you may have now or in the future against the Organizations. This means you agree not to sue the Organizations for any injuries or losses you may experience.

Acceptance of Risks and Potential Losses:
-You freely accept and fully assume all risks and the possibility of personal injury, death, property damage, expenses, and related losses (including loss of income) resulting from your participation in the Activities.

Complete Release and Indemnification:
-You forever release and promise to protect (indemnify) the Organizations from any claims, demands, actions, damages (including direct, indirect, special, and consequential damages), losses, lawsuits, judgments, and costs (including legal fees) that you have now or may have in the future.

This includes any claims that might arise from, result from, or relate to your participation in the Activities, even if these claims are caused by any reason whatsoever, including negligence, gross negligence, negligent rescue attempts, omissions, carelessness, breach of contract, or breach of any legal duty of care by the Organizations.

COVID-19 Specific Release and Indemnification: You specifically and forever release and promise to protect (indemnify) the Organizations from any action related to you becoming exposed to or infected by COVID-19 as a result of, or from, any action, failure to act, or negligence of yourself or others, including but not limited to the Organizations.

No Liability for Property Damage:
-The Organizations are not responsible or liable for any damage to your vehicle, personal property, or equipment that may occur due to your participation in the Activities.

Definition of Negligence:
-You understand that negligence includes the Organization failing to take reasonable steps to keep you safe from the risks, dangers, and hazards associated with the Activities.

Severability:
-This agreement is intended to be as broad as legally permitted in Ontario. If any part of this agreement is invalid, the remaining parts will still be in full force and effect.

7. Governing Law and Jurisdiction

You agree that if you ever need to file a lawsuit against the Organizations, you will only do so in the courts located within the Province of Ontario. You also agree that the laws of the Province of Ontario will be the only laws used to resolve any legal issues, without considering any rules about which jurisdiction's laws should apply.

8. Acknowledgement of Understanding and Voluntary Agreement

By signing below, you let me know that you have read and fully understood this agreement. You confirm signing this agreement voluntarily and without any pressure or coercion. You also understand that this agreement is binding not only on you but also on your heirs, spouse, children, guardians, next of kin, executors, administrators, and legal or personal representatives. Also, you acknowledge that by signing this agreement, you are giving up your right to bring a lawsuit against the Organization based on any of the claims you have released in this document.
