2023 JADBL Waiver Form

To submit the league waiver electronically, fill in all the required fields (*) and electronically sign the form. Please only submit ONE waiver form for the John A. DeBenedictis Baseball League. If you play in more than one age division, one waiver form covers you for all age divisions.

WAIVER AND RELEASE OF LIABILITY - READ BEFORE SIGNING
In consideration of being allowed to participate in any way for the Men's Senior Baseball League, Inc / Men's Adult Baseball League, Inc (MSBL/MABL), its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that:
1. Participation includes possible exposure to an illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce the risk, the risk of serious illness and death does exist; and,
2. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
4. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Company immediately; and,
5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS MSBL/MABL, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I hereby agree and consent to the following parameters as conditions of participation in the Men's Senior/ Men's Adult Baseball Leagues, Inc:
1. I have read the above stated release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without inducement.
2. I will observe all rules as established by the Men's Senior/Adult Baseball League, Inc.
3. I understand that fighting, physical abuse of players, umpires, or spectators, and the use of abusive or offensive language will not be tolerated by the MSBL/MABL and violation of this rule could result in my banishment or suspension from the tournament and forfeiture of all fees paid.
4. I realize that Men's Senior Baseball League, Inc. and facilities do NOT possess a defibrillator or any other medical or life saving equipment.
5. I realize that there is no guaranteed playing time on any given team, associated with regular season and tournament play.
6. I certify that I am, or will turn the appropriate age, or older, for my league this calendar year.


Terms of Acceptance and Signature

I have agreed to submit this waiver by electronic means. By signing this waiver electronically, I understand that clicking the Electronic Signature checkbox and the Submit Form button constitutes a legal signature, confirming that I acknowledge and agree to all of the stated conditions.

I also certify that:
a. I understand all of the statements on this waiver and all of my responses are correct and complete to the best of my knowledge.
b. I have read and understand all of the information presented on the waiver form.
c. I understand the penalties for giving false information on the waiver form.
d. I understand that by signing the form electronically, it verifies that the waiver form was completed by me and no one else completed or electronically signed this waiver form on my behalf.
e. I understand that an electronic signature has the same legal effect and can be enforced in the same way as a written signature.
f. I understand that MSBL and JADBL will rely on this form as authentic and represents your decision to execute the form.
